Copyright Ownership and Transfer By submitting written description, story, text, rhyme, verse, composure, or other written words, symbols, signs, numbers, formulas, tables, or slogans and artwork here after known as "the material, material, or materials" to any e-mail address linked to at (www.painbrain.com/ss/umonster.htm), here after referred to as "this url," the submitting party, here after referred to as "you or your," are certifying and attesting to the fact that you are the creator and owner of the rights to the material or the agent of the copyright owner of the material being submitted under this agreement and that you grant the publishers and copyright holders of APOCalypse 2500, Sword & Sigil, and entities we may be associated with or pass the rights to, here after referred to as "us, we, or our," the exclusive, perpetual, and royalty free ownership of the materials you submit to us via email, fax, wire transfer, us mail, currier, or any other means of delivery to us. You additionally agree that you will not receive compensation for your submissions and you will surrender any future claims of authorship or ownership of materials submitted to us and any claim for reimbursement, compensation, moneys, cash, credit, royalties, trade, or any object, consideration, recognition, or other things considered to have value or not in exchange for the transfer to us of sole and exclusive rights to and ownership of the materials you submit or otherwise send to us under this agreement. Beginning the moment you electronically, or physically mail, e-mail, transmit, wire, deliver, or in any other way make available, deliver, send, or transmit to us the material, we will be the exclusive copyright holders from that moment on to the materials you submit and to any derivative works produced now or any time in the future. All material we receive from you will be received as per this agreement and will be assumed to have been given free and clear to us as our sole copyrighted property with no compensation owed to the originator, or any agents, associates, employees, or other persons or entities involved in the process of producing or delivering of the material submitted to us by you. You further stipulate that we may now or at any time in the future and free of obligation to compensate you or any entities you are associated, doing business, contracted to or otherwise indentured to by future agreement as this agreement supersedes all future agreements and licenses pertaining to your current identity, when associated to the material you submit under this agreement, as provided by you for our use. By associating said identity(s)we are not obligated to give you now or in the future any credit, or rights to the material as the creator of the material you submit under this agreement and any such accreditation, notation, or acknowledgment will be made or not at our sole discretion and without us incurring any future obligation to recognize, compensate, reimburse, or give any notation or thing of value to you or any of your associates. b. Penalties for Copyright Violation Persons submitting copyrighted materials to which they do not have ownership of the copyright and or did not create the material as an original work or submitted works that are not fee and clear of other leans, entitlements, contractual claims, common law claims, or other impediments to free transfer of ownership under this agreement may be liable for copyright infringement. If any case of copyright infringement or claim of ownership against or of the material you submit in part or whole is brought to our attention, we will work with authorities and the legal copyright claimants to assist in identifying the persons responsible for submission of the material and assisting the copyright claimants via legal deposition under the law. We also reserve the right to bring legal action against persons or entities who submit materials to us who we feel may have had reasonable knowledge that such materials may not have been their sole property to transfer ownership to us and thereby may have initiated a fraudulent action by submitting said materials to us and without our knowledge and further caused or unwitting participation in and involuntary complicity to steal or otherwise illegally use another's intellectual property or copyright. c. Acceptable Form of Submission The subject line for submissions must read "For Apocalypse 2500." All submissions must contain your full legal name city of residence zip code and your real e mail address, and such will be assumed to be your real identity and will also be assumed to be the identity of the original creator and or legal copyright owner of the material which you are submitting to us and thereby transferring ownership to us per section (a.). You may attach your material as a file in one of the following forms: rtf or pdf only with the artwork embedded in the document or as a separate jpg of at least 150dpi minimum to 300dpi maximum. The maximum size of your attachment may not be more than 1Mb (1,000 Kb) or it may be rejected by our mail server. d. Correspondence No Return replies will be sent to you regarding submissions or their final disposition. If you submit repeats of the same materials more than two(2)times we will block your email from our system and you MAY NOT participate in the future. Submissions that are incomplete or that we have reason to believe are not original works will be deleted without return reply. No inquiries will be answered as to the disposition of material submitted to us as per section (a.) you have surrendered any right or claim to said material. No guarantees are given by us that any material you submit will ever be used or that such submissions will in fact be reviewed. We reserve the right to reject, dispose of, keep in archive, or transfer to a third party any material submitted to us, as such materials received by us will be deemed to have been given to us by you for our sole use as we see fit perpetually and without limitation or forfeiture at any time in the future for any reason whatsoever. e. Reservations and Remedies NO OWNERSHIP OF OUR COPYRIGHTED PROPERTY IS TRANSFERED OR IMPLIED TO BE SO DONE AS WE RETAIN AND RESERVE ALL RIGHTS TO OUR INTELLECTUAL AND COPYRIGHTED PROPERTY AND ALL ASSOCIATED LOGOS, TRADEMARKS, AND SLOGANS INCLUDING BUT NOT LIMITED TO THIS WEBSITE AND ALL ASSOCIATED LINKS AND CONTENT THEREIN OR LINKED TO. YOU DO NOT HAVE THE RIGHT TO USE ANY APOCalypse 2500 NAMES, LOGOS, LIKENESSES, OR ASSOCIATIONS OR ASSOCIATIONS TO CONTENT REPRESENTED ON OR LINKED TO FROM THIS OR ANY ASSOCIATED WEBSITE, PUBLICATION, ARTWORK, NAME, LOGO, OR SLOGAN AS A RESULT OF YOUR PARTICIPATION IN THIS SUBMISSION PROCESS OR AS A RESULT OF US PUBLISHING CREATURES, CHARACTERS, BEASTS, MONSTERS, ARTWORK, LANGUAGE, STORIES OR ANY OTHER MATERIAL YOU MAY SEND US. Any part of this agreement found to be unenforceable due to local law or ordinance will be reformatted only to the extent to which it becomes enforceable and all other sections, paragraphs, sentences, phrases, and worlds will survive such reformation. Persons submitting materials under the terms of this agreement will be assumed to be of legal status which allows them to enter into agreement and contract under common laws in and under the jurisdiction of the United States of America. Persons under age 13 at the time of submission may not participate. This document comprised of sections (a.) through (e.) entitled "Terms and conditions for submitting original material to Sword & Sigil" and displayed electronically at this url, constitutes the entire agreement between Us and You and no other terms or agreements, relationships, or associations are expressed or implied.
