A. Purpose: This license is NOT a "GNU," license. It is a license for the licensee to use the RPG PERCENTILE SYSTEM in derivative works for profit or for free in Role Play Game systems of both tabletop and electronic types. You may use the RPG PERCENTILE SYSTEM as the functional apparatus of your game system or to make compatible systems or additions to other RPG PERCENTILE SYSTEM based games under the terms as stated in paragraphs 1 through 14 of this license. 1. Definitions: (a)"Source Producer" means the copyright and/or trademark owners who have created the RPG PERCENTILE SYSTEM; (b)"Derivative Works" means copyrighted material including derivative works and translations (including into computer code), potation, modification, correction, addition, extension, upgrade, improvement, compilation, abridgment or other form in which an existing work may be recast, transformed or adapted; (c) "Distribution " means to reproduce, license, rent, lease, sell, broadcast, publicly display, transmit or otherwise distribute or make available; (d)"RPG PERCENTILE SYSTEM Content" or simply," "Content," means the game formulaic methods and includes all systems, matrixes, and application of all mechanisms, procedures, processes and routines as described and detailed in any documents created by the Source Producer to the extent such content does not embody the Product Identity and is an enhancement over the prior art and any additional content clearly identified as RPG PERCENTILE SYSTEM Content by the Source Producer, and means any work covered by this License, including translations and derivative works under copyright law, but specifically excludes Product Identity. (e) "Product Identity" means product and product line names, logos and identifying marks including descriptions, situations, places, personages, or any original material associated with but not derived from the RPG PERCENTILE SYSTEM but that is created to utilize the RPG PERCENTILE SYSTEM, including entire game systems that utilize the RPG PERCENTILE SYSTEM as their functional apparatus, and any other trademark or registered trademark clearly identified as Product identity by the owner of the Product Identity, and which specifically excludes the RPG PERCENTILE SYSTEM Content; (f) "Trademark" means the logos, names, mark, sign, motto, designs that are used by a Source Producer to identify itself or its products or the associated products contributed to the RPG PERCENTILE SYSTEM License by the Source Producer (g) "Use", "Used" or "Using" means to use, Distribute, copy, edit, format, modify, translate and otherwise create Derivative Material of RPG PERCENTILE SYSTEM Content. (h) "You" or "Your" means the licensee in terms of this agreement.(i) "Licensee," is any person, company, corporation, or other legal entity who reproduces or uses the RPG PERCENTILE SYSTEM in hole or part in any distributable way, including but not limited to electronic transmission, making available on websites or in web-logs, in printed materials, as part of a larger work, or incorporation into any gaming system printed or electronic in nature. 2. The License: This License applies to all RPG PERCENTILE SYSTEM Content and may only be Used under and in terms of this License. You must affix such a notice to any RPG PERCENTILE SYSTEM Content that you Use. No terms may be added to or subtracted from this License except as described by the License itself. No other terms or conditions may be applied to any RPG PERCENTILE SYSTEM Content distributed using this License. 3. Offer and Acceptance: By Using the RPG PERCENTILE SYSTEM Content You indicate Your acceptance of the terms of this License. 4. Grant and Consideration: In consideration for agreeing to this License, the Source Producer grants You a perpetual, USA (united States of America)only, royalty-free, non-exclusive license with the exact terms of this License to Use, the RPG PERCENTILE SYSTEM Content. 5. Licensed use: You are licensed to use the RPG PERCENTILE SYSTEM Content as part of gaming systems or as an addendum to existing systems for which you have the right to create such derivatives or associations to for profit. You MAY NOT redistribute the full RPG PERCENTILE SYSTEM Content under this license as a stand alone work, however you may hot link to www.swordandsigil.com from a web presence that is not associated with any adult, hate related, or illegal websites, or organizations for the express purpose of aiding others in locating the RPG PERCENTILE SYSTEM content for download from the source producer. You may under no circumstance charge for the redistribution of the RPG PERCENTILE SYSTEM in its original form nor may you alter it for the sole purpose of profitable redistribution. Simply rephrasing , reprinting, translating, or other simple editing or re-typesetting of the RPG PERCENTILE SYSTEM in print or electronically for profit is STRICTLY FORBIDDEN under this license. Use of Product Identity: You agree not to Use any Product Identity, including as an indication as to compatibility, except as expressly licensed in another, independent Agreement with the owner of each element of that Product Identity. You agree not to indicate compatibility or co-adaptability with any Trademark or Registered Trademark in conjunction with a work containing RPG PERCENTILE SYSTEM Content except as expressly licensed in another, independent Agreement with the owner of such Trademark or Registered Trademark. The use of any Product Identity in RPG PERCENTILE SYSTEM Content does not constitute a challenge to the ownership of that Product Identity. The owner of any Product Identity used in RPG PERCENTILE SYSTEM Content shall retain all rights, title and interest in and to that Product Identity. 7. Identification: If you distribute RPG PERCENTILE SYSTEM Content in whole or part You must clearly indicate which portions of the work that you are distributing are RPG PERCENTILE SYSTEM Content by using one of the following methods listed in 7a or 7b. 7a. When used as part of a larger work, placing the notice "Game mechanics based on the RPG PERCENTILE SYSTEM copyright 2007 John Arnold www.swordandsigil.com" on the copyright page of your printed work in no less than 12pt. Font, or in the credits section of your electronic media and on the outside packaging of any electronic media in a font size equal to all other copyright notices. 7b. By obtaining licensing agreement from the Source Producer to use one of the approved trademarks of the RPG PERCENTILE SYSTEM, and using said in compliance with the trademark licensing agreement. 8. Updating the License: the author or its designated Agents may publish updated versions of this License. You may use any authorized version of this License to include in other works containing any RPG PERCENTILE SYSTEM Content originally distributed under any version of this License. 9. Copy of this License: You MUST include a copy of this License with every copy of derivative works containing any RPG PERCENTILE SYSTEM Content You Distribute. For printed works this license can be printed in the last pages of your work after the body of the work. For electronic distributions this license must be transmitted in the body text or in the credits section and attached as a referenced "read me file," containing in the file name "percentile_system_license." For website or web-log publication this license must be included in the main text body. If you post download links to works containing RPG PERCENTILE SYSTEM content this license must download as part of the main data stream and appear in the main body of work downloaded and be readable as all other text data in the same format so that anybody receiving said data transmission will also receive a copy of this license without the option to not receive this license.
